Terms & Conditions
The “parties” [Buyers and Circle B Farm and Auction LLC (Circle B)] agree to allocate and shift risks and burdens as between the parties, by virtue of participating in any of Circle B’s auctions, and receiving this perforated card as follows:
1. This writing fully incorporates by reference the separate documents entitled "Terms of Sale for all Buyers"
2. Seller owes Circle B full commission on sale price for any good and in any case the Seller becomes the highest bidder. This practice is commonly referred to as "Shill Bidding."
3. Seller owes Auctioneer full commission on sale price for any good and in any case a good is sold unilaterally by Seller before a auction unless Seller and Circle B agree in full.
4. Seller understands and agrees that all ownership interest in any food is immediately transferred to the Buyer (absolutely and without reserve) unless otherwise agreed to separately for Seller to have a reserve bid.
5. Circle B is not responsible for any bad checks, charge backs, or unpaid auction items.
6. Seller warrants that the goods offered at auction shall be fit for such purpose as seller represents and warrants that the good(s) are/is merchantable.
7. Seller warrants that the title conveyed shall be good and its transfer rightful; and the goods shall be delivered free from any security interest or other lien or encumbrance unless explicitly stated below.
8. Seller offers the following goods for auction (may be continued on an additional check in sheet).

This writing fully incorporates by reference the separate documents entitled "Terms Allocating and Diving Risks" which was provided to Buyer when receiving this perforated card on the day of the auction.

All purchases must be paid in full on day of sale for live in-person bidders and prior to removing goods from the premises. Buyers must pay in full imediatelt upon sale and immediately assumes the burden of protecting and taking possession of any goods.

ONline bidders must be paid in full within three business days of the sale.

Buyer's premium will be collected and retained by Circle B at a rate of 10% capped at $1500 per lot in addition to seller's fees plus an additional 2% fee for online bidders.

Circle B shall decide outcome or resale of any goods in dispute between two bidders or more (tied bids).

Circle B makes no warranties (expressed or implied) to any party that extend beyond the description the seller of the goods offers. Any bidder receives the goods "as is, where is" and "with all faults."

Buyer holds Circle B harmless for any injury, damage, or loss connected with any sale.

Cash, certified checks, bank wire transfers, and/or personal/business checks accompanied by a bank letter of credit will be accepted. If buyer does not have a bank letter or credit to accompany his/her check the buyer will not receive a paid invoice and items will not leave the premises without a paid invoice.
